Child support can be the biggest bone of contention in any divorce settlement. Don’t you have a friend that has complained about high child support payments in the past?  Has it made it hard for him to live while making those high payments? This article will help you determine how courts determine the level of child support that non-custodial parents have to pay.

The state that you live in determines basic child support rates. Lawmakers considered various things in order to come up with this formula:

The needs of the child. For example, if you have a child with a disability, his or her needs will be vastly different from those of a healthy child.

One of the next considerations is the type of lifestyle the child would have lived had his parents not gotten a divorce.

The amount of money the non-custodial parents needs in order to live a life of his own.

Some parents are required to support children from previous relationships, so that also needs to be taken into account.

The income of the non-custodial parent is only taken into consideration in some states.  Other states based the child support rate on the income of both parents. If only one income is taken into account, the non-custodial parent has to share financial responsibility for the child even if the other parent makes a lot more money.

It’s important to note that no child support agreement is totally inflexible. I’m sure you’ve heard of situations where the ex has taken someone to court in order to collect more money. Many people are careful around their former spouse so that they don’t take them to court for more money. Try to keep your support payments current. If your life situation changes, you can go back to court to have your payments lowered. You are only hurting yourself if you don’t keep up on the payments.
